New Delhi: The Supreme Court on Wednesday allowed Karti Chidambaram, son of senior Congress leader P Chidambaram, to travel abroad after depositing Rs 10 crore with its registry.

The apex court asked Karti to appear before the Enforcement Directorate on March 5, 6, 7 and 12 for questioning in connection with the INX Media and Aircel Maxis cases, saying "don't play around with the law".

"You go wherever you want to go, between February 10 to 26 but you must cooperate with the investigation," a bench headed by Chief Justice Ranjan Gogoi said.

"Please tell your clients that he will have to cooperate. You have not cooperated. We wanted to say a lot of things. We are not saying them right now," the bench said.

Besides asking Karti to deposit Rs 10 crore with the secretary general of the Supreme Court, the bench also asked him to file an undertaking that he would return and cooperate with the investigation.

Karti has sought permission to travel abroad from February 10 to 26 and again from March 23 to 31.

The bench was hearing Karti's plea seeking permission to travel to France, Spain, Germany and the United Kingdom for the next few months for international tennis tournaments organised by a company called 'Totus Tennis Ltd' having its registered office in the UK.

The Supreme Court on Wednesday once again refused to stay amendments to the SC/ST Act that restored the no anticipatory bail provision and said all matters including the Centre’s review petition will be heard on February 19.

A bench headed by Justice U U Lalit said the issue requires hearing in detail and it will be appropriate if all matters are heard on February 19.

The bench refused to stay the amendments to the SC/ST Act after senior advocate Vikas Singh, appearing for one of the petitioners who had challenged the changes made to the Act, sought an immediate stay on it.

The apex court had on January 25 said it will consider listing the Centre’s review and petitions challenging the amendments to the SC/ ST Act 2018, together before an appropriate bench.

The top court had earlier refused to stay the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2018 which restored the provision that no anticipatory bail be granted to the accused. Parliament on August 9 last year had passed a bill to overturn the apex court order relating to certain safeguards against arrest under the SC and ST law.

On March 20, 2018, the apex court had taken note of the rampant misuse of the stringent SC/ST Act against government servants and private individuals and said there would be no immediate arrest on any complaint filed under the law.

The top court had earlier said that the new amendments to the SC/ST law passed by Parliament cannot be stayed and had sought the Centre’s response on pleas challenging the provisions.

The pleas have sought declaration of the new amendments to the Schedule Castes and Schedules Tribes (Prevention of Atrocities) Act as ultra vires.

The amendments rule out any provision for anticipatory bail for a person accused of atrocities against SC/STs, notwithstanding any court order.

They provide that no preliminary inquiry will be required for registering a criminal case and an arrest under this law would not be subject to any approval.

The court was hearing the pleas alleging that two Houses of Parliament had “arbitrarily” decided to amend the law and restored the previous provisions in such a manner so that an innocent cannot avail the right of anticipatory bail.

The Supreme Court Wednesday allowed former Finance Minister P Chidambaram's son Karti Chidambaram to travel abroad after depositing Rs 10 crore with its registry but asked him to cooperate with the probe in the INX Media and Aircel Maxis cases, saying "don't play around with the law".

The apex court asked Karti to appear before the Enforcement Directorate (ED) on March 5, 6, 7 and 12 for questioning in connection with the INX Media and Aircel Maxis cases.

"You go wherever you want to go, between February 10 and 26 but you must cooperate with the investigation," a bench headed by Chief Justice Ranjan Gogoi said.

"Please tell your clients that he will have to cooperate. You have not cooperated. We wanted to say a lot of things. We are not saying them right now," the bench said.

The top court had on Monday asked the ED to specify the date on which it wants to interrogate Karti.

Besides asking Karti to deposit Rs 10 crore with the secretary general of the Supreme Court, the bench also asked him to file an undertaking that he would return and cooperate with the investigation.

Karti has sought permission to travel abroad from February 10 to 26 and again from March 23 to 31.

The bench was hearing Karti's plea seeking permission to travel to France, Spain, Germany and the United Kingdom for the next few months for international tennis tournaments organised by a company called 'Totus Tennis Ltd' having its registered office in the UK.

The plea, which also said that Karti is associated with tennis as a "former player, current administrator and entrepreneur", is being opposed by the ED.

The court had on Monday said that it will ensure that he appears before the agency and also goes for his tennis assignment, adding that "No tennis for him if he evades".

The apex court had earlier refused urgent hearing on the plea of Karti saying, "Who is Karti? Karti Chidambaram, you are saying? Let him stay where he is. We have more important matters to decide".

On September 18 last year it had allowed Karti to travel to the UK from September 20-30.

Karti is facing criminal cases which are being investigated by the ED and the CBI.

One of the cases relates to the FIPB clearance to INX Media for receiving foreign funds of Rs 305 crore when his father was the finance minister.

The ED had said that Karti, who is also facing proceedings in cases like Aircel-Maxis and money laundering matters, has been "blatantly misusing" the liberty granted by court in allowing him to travel abroad and has been using the same to protract the investigation in the case.

The Supreme Court on Wednesday allowed Karti Chidambaram to travel to the UK and Spain in February and March adding a stern rider directing him to co-operate with the Enforcement Directorate (ED) in its probe into his alleged role in the INX Media and Aircel Maxis case.

Failing which it would be viewed seriously, the court told the son of former Union Minister P. Chidambaram. His travel dates are from February 10 to 26 and again March 23 to 31.

Allowing him to "go where ever you want, do whatever you want", Chief Justice Ranjan Gogoi warned: "Don't play around. Not an inch of non-cooperation will be tolerated. You are not cooperating."

A bench of Chief Justice Gogoi, Justice Deepak Gupta and Justice Sanjiv Khanna asked Chidambaram junior to appear before the ED for "further investigation" on March 5, 6, 7, and 12.

Apart from giving an undertaking, the court also directed Chidambaram junior to deposit Rs 10 crore as security with the Secretary General of the Supreme Court.

As senior counsel K.V. Vishwanathan appearing for the senior Congress leader's son wanted to say something on the security deposit, Gogoi said: "Do you want us to add another zero?"

At the outset, Solicitor General Tushar Mehta told the court that the ED has fixed his questioning dates between his first travel to the UK from February 10 to 26 and before his second travel to Spain from March 23 to 31.

The court in its last hearing on Monday had asked the ED to indicate the dates when it would like to question Chidambaram junior.

Telling Karti Chidambram that the court will "come down very heavily" on him if there was "an iota of non-cooperation" by him, the bench asked him to appear before the authorities (ED) on the dates mentioned and cooperate in every manner.

The court said: "Any non-cooperation would be viewed very seriously."

The Northeast Frontier Railway (NFR) is facing the menace of 628 unauthorised level crossings in its jurisdiction, posing threat to the safety of trains, passengers and people who use such stretches, an official said Tuesday. Level crossings are designated spots designed to facilitate safe passage of road vehicles, unauthorised level crossings are those which locals build across tracks using soil, where trains are not supposed to stop or slow down. There are 628 such unauthorised level crossings in Assam, West Bengal and Bihar, though the NFR has eliminated all un-manned level crossings in its jurisdiction, its Chief Public Relations Officer P J Sharma said here. “The presence of these crossings is posing a big threat to safety of train movement and to the safety of the people who use them, he said.

As these crossings are not protected, there have been a number of deaths due to collision between trains and vehicles. Since these are not designated crossings, people who suffer injury or loss of life while crossing them are not
entitled to get any compensation from the railway’s end, the NFR spokesman said. The latest of such accidents had taken place on January 27 when Lokmanya Tilak TerminousGuwahati Express rammed into a vehicle near Bongaigaon leading to the death of two people and serious injury to another, apart from affecting train movement.

Out of the total 628 of such un-authorised crossings within N-F Railway, 374 are in Assam, 194 in West Bengal and
60 are in Bihar. At a time when sectional speeds of trains are being increased and more and more high speed premium trains are being run, the CPRO said such trespassing have posed a major threat to safety of trains. Loss of punctuality is also a result of such trespassing as trains have to be slowed down regularly at some of these locations, he added.
